Terms of Service

1. Acceptance of Terms

By downloading, installing, or using GamePinned software and related services ("the Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services. These Terms apply to all users, including free, trial, and paid license holders.

2. License Grant

2.1 License Types

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the software for the tier and seat count associated with your license:

  • FREE: Protect 1 game on the licensed device. No expiration.
  • TRIAL: Full feature access for 30 days. Requires a valid payment method. Automatically converts to a paid subscription at the end of the trial period unless canceled. One trial per customer.
  • PERPETUAL (ELITE): Protect unlimited games on the number of devices specified at purchase. One-time payment, no expiration.
  • SUBSCRIPTION (PRO): Protect unlimited games on the number of devices specified at purchase. Recurring payment required to maintain access.

2.2 Restrictions

You may not:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the software
  • Modify, adapt, translate, or create derivative works based on the software
  • Remove or alter any proprietary notices or labels on the software
  • Share, sublicense, resell, rent, or otherwise distribute your license key to third parties
  • Use the software on more devices than your license permits
  • Circumvent any license validation, device binding, or anti-abuse mechanisms
  • Use the software in any manner that violates applicable law

3. Device Binding

Each license is bound to the device(s) on which it is activated. We use device identification technology to enforce this binding. Activating a license on a different device requires deactivation of the original device and is subject to our seat limits. Significant hardware changes may require re-activation. Contact support if this becomes necessary due to hardware failure or replacement.

4. Acceptable Use

4.1 Permitted Use

The software is intended for use by business operators and individuals to protect game installations in multi-user environments, including but not limited to gaming cafes, internet centers, shared computers, and family PCs where the licensee owns or has authorization to manage the device.

4.2 Prohibited Use

You may not use the software to:

  • Violate any applicable law or regulation
  • Restrict access to systems you do not own or are not authorized to manage
  • Harm, harass, or impersonate any person
  • Distribute malicious software or engage in any fraudulent activity

5. Payment and Billing

5.1 Fees

Paid licenses require payment through our authorized payment processor. All fees are in USD unless otherwise stated at the time of purchase. We reserve the right to change pricing at any time, with changes taking effect at the next billing period for existing subscribers.

5.2 Refunds

Refunds are available only where the software does not perform as described and the issue cannot be resolved through support. Refunds are not available for change of mind, hardware changes, or violations of these Terms. To request a refund, contact support@gamepinned.com.

6. Subscriptions and Trials

Subscription licenses renew automatically at the end of each billing period unless canceled before the renewal date. You are responsible for canceling before renewal if you no longer wish to be charged.

Free trials require a valid payment method. Your payment method will be charged at the then-current subscription rate at the end of the trial period unless you cancel before expiration. No separate notice is sent before the trial converts. You may cancel at any time via your account portal or by contacting support@gamepinned.com.

One free trial per customer. We use device identification and email address to enforce this limit. Circumventing this limit, including by using alternate email addresses or devices, is a violation of these Terms and may result in immediate termination of all associated licenses without refund.

7. Communications

By purchasing a license or starting a trial, you consent to receive transactional communications related to your account, including license delivery, billing receipts, renewal notices, and service updates. These communications are necessary to provide the service and cannot be opted out of while your account is active.

We may also send marketing and product update emails. You may opt out of these at any time by clicking the unsubscribe link in any such email or contacting us. Opting out of marketing emails does not affect transactional communications.

8. Updates and Support

Active paid license holders receive software updates, bug fixes, and email support. Support is provided on a best-effort basis with no guaranteed response times. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice where practicable.

9. Data Collection

Use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to data collection and use as described in that policy, including device identification for license enforcement and usage telemetry for service improvement.

10. Third-Party Platforms

The software interacts with third-party platforms including Steam, Epic Games, and Riot Games. GamePinned is not affiliated with, endorsed by, or sponsored by these companies. Your use of those platforms remains subject to their respective terms of service. We are not responsible for any changes to third-party platforms that affect the functionality of our software.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR PREVENT ALL UNAUTHORIZED ACTIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GamePinned AND ITS DEVELOPERS, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access immediately, without prior notice or refund, for violation of these Terms, fraudulent or illegal activity, or abuse of the trial system.

Upon termination of a paid license, access reverts to the free tier. Sections of these Terms that by their nature should survive termination will do so.

14. Intellectual Property

All rights, title, and interest in the Services, including all intellectual property rights, are owned by GamePinned. These Terms do not grant you any rights to our trademarks, logos, or branding. Any feedback or suggestions you provide may be used by us without obligation.

15. Governing Law and Disputes

These Terms are governed by applicable law. Any dispute arising from or relating to these Terms shall be resolved first by informal negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction. Contact us at support@gamepinned.com to initiate the informal process.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website. Continued use of the Services after the effective date of changes constitutes acceptance.

17. Severability and Entire Agreement

If any provision of these Terms is held to be unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and GamePinned regarding the Services.
